These Terms and Conditions govern your use of the CareForce1 Recruitment website (“Website”) and the recruitment and staffing services provided by CareForce1 Recruitment (“CareForce1”, “we”, “us”, or “our”). By accessing or using our Website or services, you agree to be bound by these Terms. If you do not agree, you must not use our Website or services.

1. About Us

CareForce1 Recruitment provides recruitment and staffing support within the care and support sector in Australia, including disability and aged care services.

2. Use of the Website

You agree to use this Website lawfully and not to:

● Provide false, misleading, or incomplete information
● Interfere with or disrupt the Website or its security
● Attempt unauthorised access to systems or data
● Use the Website in breach of any applicable laws or regulations

CareForce1 reserves the right to suspend or terminate access to the Website where misuse occurs.

3. Recruitment Services – General

CareForce1 acts solely as a recruitment intermediary between job seekers and care providers.

CareForce1:

● Does not employ candidates unless expressly stated in writing
● Does not guarantee placement, employment, or minimum hours
● Does not control employment terms once a candidate is engaged

All final hiring and engagement decisions remain the responsibility of the provider or employer.

4. Job Seekers

By submitting your information to CareForce1, you acknowledge that:

● All information provided must be accurate and current
● You are responsible for maintaining required licences, checks, and qualifications
● Placement outcomes depend on provider needs, suitability, and availability CareForce1 does not guarantee:
● Employment offers
● Ongoing or minimum hours
● Specific roles, locations, or conditions

5. Providers / Employers

Providers engaging CareForce1 services acknowledge that:

● Candidate suitability is assessed based on information reasonably available at the time
● Final screening, induction, supervision, and compliance remain the provider’s responsibility
● CareForce1 does not replace or assume regulatory, industrial, or NDIS compliance obligations

Recruitment fees, service scope, and guarantees may be governed by separate written agreements.

6. Placement Guarantee and Replacements

CareForce1 offers a replacement guarantee, not a refund, for permanent placements unless otherwise agreed in writing.

a) Replacement Guarantee

Where a candidate placed by CareForce1 leaves employment or is deemed unsuitable by the provider within 90 days of commencement, CareForce1 will use reasonable efforts to source one replacement candidate for the same role at no additional recruitment fee. This guarantee applies only where:

● The role requirements have not materially changed
● The provider has provided reasonable onboarding, training, and supervision
● The termination was not due to factors outside the candidate’s control

b) Exclusions

The replacement guarantee does not apply where termination or resignation is due to:

● Inadequate induction, training, or supervision
● Changes to role scope, duties, or working conditions
● Reduction in hours, roster changes, or client cancellations
● Client incompatibility not disclosed to CareForce1 prior to placement
● Breach of workplace policies not communicated to CareForce1
● Redundancy, business restructure, or operational changes

c) No Refunds

Recruitment fees are non-refundable once a placement has commenced. CareForce1 does not offer probationary refund periods. The replacement guarantee represents the sole remedy available in relation to placement suitability, to the extent permitted by law. 7. Accuracy of Information While CareForce1 takes reasonable steps to verify candidate information, we:

● Rely on information supplied by candidates and third parties
● Do not warrant that information is complete, current, or error-free Providers agree to conduct their own due diligence before making hiring or engagement
decisions.

8. Limitation of Liability

To the maximum extent permitted by law:

● CareForce1 is not liable for indirect, incidental, or consequential loss
● We are not responsible for the actions or omissions of candidates or providers
● Liability is limited to the re-supply of services where applicable

Nothing in these Terms excludes rights under the Australian Consumer Law.

9. Intellectual Property

All Website content, including text, branding, logos, and graphics, is the property of CareForce1 unless otherwise stated. Content may not be reproduced, distributed, or used without prior written consent.

10. Third-Party Links

The Website may contain links to third-party websites. CareForce1 does not control or endorse those websites and is not responsible for their content or  practices.

11. Privacy

Personal information is handled in accordance with the CareForce1 Privacy Policy, available on the Website.

12. Changes to These Terms

CareForce1 may update these Terms from time to time. Continued use of the Website constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Australia, and any disputes are subject to the jurisdiction of the Australian courts.
